Terms of Service

Welcome to Top Tier. These Terms of Service (“Terms”) are a binding agreement between you and Top Tier (“Top Tier,” “we,” “us”) and govern your use of the Top Tier iOS app, our website at toptiereats.app, and any related services (collectively, the “Service”). By creating an account or using the Service, you agree to these Terms.
1. Eligibility
You must be at least 13 years old to use Top Tier. If you are under the age of majority in your jurisdiction, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. The Service is not intended for children under 13 and we will remove accounts we discover are held by someone under 13.
2. Your account
You create an account by signing in with a supported identity provider (for example, Apple or Google). You are responsible for maintaining the security of the provider account you sign in with and for everything that happens under your Top Tier account. Tell us promptly if you suspect unauthorized access.
One human, one account. Do not impersonate anyone or misrepresent your affiliation with a person, place, or organization.
3. Your content
Top Tier lets you create S-tier lists and rank places. Anything you post, including your rankings, display name, and bio, is “Your Content.” You own Your Content.
You grant Top Tier a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify (for example, to format for different screen sizes), display, and distribute Your Content for the purpose of operating and improving the Service and providing it to other users. This license lasts as long as Your Content is on the Service; it ends when you delete Your Content or your account, subject to the retention terms in our Privacy Policy.
You represent that you have the rights needed to post Your Content and that Your Content does not violate these Terms or any law.
4. Acceptable use
You agree not to use the Service to:
- Post content that is unlawful, defamatory, threatening, harassing, hateful, sexually explicit, or that incites violence.
- Harass, bully, stalk, or intimidate anyone.
- Impersonate another person or misrepresent your affiliation with a person, place, or organization.
- Post spam, affiliate links, advertising, or content that is not a good-faith ranking.
- Interfere with, probe, scrape, or attempt to reverse-engineer the Service, its APIs, or its security mechanisms.
- Upload malware or attempt to gain unauthorized access to any part of the Service or to other users’ accounts.
- Violate any applicable law or third-party rights.
We have zero tolerance for objectionable content or abusive users. We may remove content and suspend or terminate accounts that violate these rules, at our sole discretion and without notice.
5. Reporting and blocking
You can report any list, profile, or piece of content from inside the app. Reports go directly to our moderation queue and are reviewed promptly — we target acting on any report of objectionable content within 24 hours, including by removing the content and banning the user who posted it where appropriate.
You can also block other users from inside the app. Once you block someone, you will not see their profile, rankings, or activity, and they will not be able to follow or interact with you.
6. The Service is free
Top Tier is currently free to use. There are no subscriptions, no in-app purchases, and no paid tiers. If we introduce paid features in the future, they will be optional, we will post new terms covering them, and we will give you notice before any charges apply.
7. Intellectual property
The Service, including its software, design, text, graphics, logos, and trademarks (other than Your Content), is owned by Top Tier or its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial use, subject to these Terms.
“Top Tier” and the Top Tier logo are our trademarks. You may not use them without our written permission.
8. Third-party services and places
Top Tier references real businesses (restaurants, bars, cafes, and similar venues). Ranked places are identified using Google Places data for accuracy; we do not control those businesses and we are not affiliated with them unless expressly stated. Opinions expressed by our users are theirs, not ours.
9. Termination
You can stop using the Service at any time and can delete your account from Settings. We may suspend or terminate your access at any time if you violate these Terms, if we are required to by law, or if we discontinue the Service. Sections that by their nature should survive termination (including content license for content you have not deleted, intellectual-property, disclaimers, and limitation of liability) will survive.
10. Disclaimers
The Service is provided “AS IS” and “AS AVAILABLE” without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any information you find on the Service is accurate. Rankings reflect the opinions of our users, not us.
11. Limitation of liability
To the fullest extent permitted by law, Top Tier and its officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or in connection with your use of the Service. Our total aggregate liability for any claim arising out of these Terms or the Service will not exceed USD 100 or the amount you paid us in the preceding twelve months, whichever is greater.
12. Indemnification
You agree to defend, indemnify, and hold harmless Top Tier from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of Your Content, your use of the Service, or your violation of these Terms.
13. Apple App Store additional terms
This section applies if you use Top Tier on a device running iOS. These Terms are an agreement between you and Top Tier, not with Apple Inc. (“Apple”). Apple is not responsible for the Service or its content.
- Your license to use the iOS app is limited to a non-transferable license to use it on an Apple-branded device you own or control, as permitted by the Apple Media Services Terms.
- Apple has no obligation to provide maintenance or support for the iOS app.
- If the iOS app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the iOS app.
- Top Tier, not Apple, is responsible for addressing any product liability claims, claims that the iOS app does not conform to legal requirements, and claims arising under consumer protection or similar laws.
- In the event of any third-party claim that the iOS app or your use of it infringes that third party’s intellectual-property rights, Top Tier (not Apple) will be solely responsible for the investigation, defense, settlement, and discharge of that claim.
- You represent that you are not located in a country that is subject to a U.S. government embargo or that has been designated by the U.S. government as a “terrorist supporting” country, and that you are not listed on any U.S. government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
14. Changes
We may update these Terms from time to time. If the changes are material we will post a notice in the app or on the website and update the “Last updated” date. Your continued use of the Service after the changes take effect means you accept the updated Terms.
15. Governing law
These Terms are governed by the laws of the State of Missouri, United States, without regard to its conflict-of-laws rules. The exclusive venue for any dispute arising out of these Terms or the Service is the state or federal courts located in St. Louis, Missouri, and you consent to personal jurisdiction in those courts. Nothing in this section limits any non-waivable consumer rights you have in your place of residence.
